Privacy Policy

1. Who we are

This Privacy Policy describes how AWEX Arizona Pool Care, operating under the legal name published on the Site when available, or under the names "AWEX" and "Arizona Pool Care" as used on the Site (the "Company," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with the website at https://awex.co (the "Site"), related quote and support forms, and customer portals accessed through private token links (including onboarding, service reports, and repair approvals).

We operate residential pool care and maintenance services in Arizona and use the Site for lead generation, customer communications, and service operations. Our service area is Arizona (Phoenix metro and surrounding communities). We do not publish a public street address on the Site unless and until an address is configured and displayed there.

For privacy requests or questions, contact us using the phone number, email address, or contact form published on the Site (including the Contact page). Do not rely on outdated contact details from third-party directories.

2. Scope

This Policy applies to personal information we collect:

  • through the Site, including quote forms, support forms, and pages that measure traffic or conversions;
  • through customer onboarding and operational workflows initiated from the Site or from links we send you;
  • through private token links for service reports and repair approvals; and
  • offline or by phone, SMS, or email when that information is combined with Site or portal records for quotes, scheduling, or service delivery.

Separate written service agreements may contain additional terms about how we handle information for contracted customers. If those terms conflict with this Policy for a specific engagement, the service agreement controls for that engagement to the extent permitted by law.

This Policy does not cover third-party websites or services that we do not control, even if linked from the Site.

3. Categories of personal information we collect

Depending on how you interact with us, we may collect the following categories of personal information:

3.1 Identifiers and contact information

  • Name
  • Email address
  • Phone number
  • Service ZIP code and approximate service location (city or area)
  • Online identifiers such as cookie IDs, device IDs, and IP address (when collected by our systems or analytics tools)

3.2 Pool and service details

  • Service intent (for example weekly care, one-time clean, or equipment care)
  • Pool basics you provide (size, type, condition notes, equipment notes, and similar details needed for a quote or visit)
  • Scheduling preferences and service history once you become a customer
  • Visit notes, chemistry or maintenance observations, photos, and repair descriptions shared through service reports or repair workflows

3.3 Access notes and gate codes

Optional customer onboarding and operations forms may collect access notes, gate codes, lockbox instructions, pet notes, and similar information needed to reach your pool safely. We collect this information for service delivery only. It is not published on public pages, not included in analytics event payloads, and not intended for search engine indexing.

3.4 Device, usage, and technical data

  • Browser type, device type, operating system, referring URL, pages viewed, and approximate timestamps
  • Interaction events such as form starts, quote submissions, and phone or email click labels (location labels only, not full message content)

3.5 Attribution and marketing source data

  • UTM parameters, campaign identifiers, referrer category, and similar attribution fields when present
  • Landing page path and related context that helps us understand how you found us

3.6 Communications

  • Messages and notes you submit through forms or send by email, SMS, or phone
  • Records of our responses and follow-up related to quotes, support, or service

We do not require sensitive government ID numbers through the public Site quote form. Do not submit payment card numbers through free-text form fields.

4. Sources of personal information

We collect personal information from:

  • You, when you fill out forms, open portal links, call or text us, or email us
  • Your devices and browsers, through cookies, local storage, pixels, and similar technologies (see our Cookie Policy)
  • Service providers that process data on our behalf (for example hosting, email delivery, and analytics)
  • Publicly available sources or referrals only when relevant to responding to a request you initiated or to operating our business lawfully

5. How we use personal information

We use personal information to:

  • Respond to quote requests, confirm service fit, and discuss pricing and scheduling
  • Deliver pool care and related services, including routing technicians and using access notes when you provide them
  • Operate customer portals for onboarding, service reports, and repair approvals
  • Communicate with you by phone, SMS, email, or Site forms about quotes, visits, repairs, support, and account matters
  • Measure and improve the Site, conversion flows, and marketing attribution
  • Maintain security, prevent fraud and abuse, debug systems, and protect our rights and users
  • Comply with law, respond to lawful requests, and resolve disputes
  • Create de-identified or aggregated insights that do not reasonably identify you

6. Phone, SMS, and TCPA-style consent

If you provide a phone number in a quote form, support form, or other Site form and submit the form, you consent to the Company contacting you at that number about your request by phone call, text message (SMS/MMS), or voicemail, including using an autodialer or prerecorded/artificial voice where permitted by law. Message and data rates may apply. Message frequency varies based on your request and our follow-up needs.

Consent to receive calls or texts is not a condition of purchasing services. You may opt out of marketing texts by replying STOP (or as otherwise instructed in the message). You may request that we stop sales follow-up calls by telling us during a call or through the contact methods published on the Site. Transactional or service-related communications about an existing quote, appointment, or customer relationship may continue as allowed by law.

7. How we disclose personal information

7.1 Service providers (processors)

We disclose personal information to vendors that process it on our behalf and under our instructions, such as:

  • Website hosting and application infrastructure (including Vercel when used to host the Site)
  • Email delivery and transactional messaging providers (including Resend when configured)
  • Analytics providers (including Google Analytics 4 and, when configured, Google Tag Manager)
  • Security, logging, error monitoring, and similar operational tools we enable
  • Professional advisors (such as accountants or insurers) when reasonably necessary

These disclosures are for business purposes (processing on our behalf), not a sale of personal information for money.

7.2 Business transfers and legal needs

We may disclose personal information if we are involved in a merger, acquisition, financing, reorganization, or sale of assets, subject to customary confidentiality protections. We may also disclose information to comply with law, court orders, or government requests; to enforce our terms; or to protect the rights, safety, or property of the Company, our customers, or others.

7.3 No sale for money; "share" clarification

We do not sell personal information for money. We do not knowingly sell or share personal information of consumers under 16.

Some privacy laws define "sale" or "share" broadly to include certain disclosures for cross-context behavioral advertising. We use analytics and similar technologies when configured. If those tools are treated as a "sale" or "share" under applicable law, you may exercise opt-out rights described in Section 12. We do not use gate codes or access notes for advertising.

8. Cookies and analytics

We use cookies, local storage, pixels, and similar technologies as described in our Cookie Policy. When analytics IDs are configured, we may load Google Analytics 4 and optionally Google Tag Manager to measure page views and conversion events (such as quote requests). Analytics event payloads are designed not to include your name, email, phone number, free-text message, or gate codes. Lead contact details remain on the secure lead or customer record.

You can block or limit analytics through browser settings or extensions. Blocking analytics does not prevent the quote form from working. Preview and staging environments may use separate analytics properties or none at all.

9. Service reports, repair links, and portals

After you become a customer (or when we send you an operational link), we may provide private token URLs for onboarding, service reports, or repair approvals. Those links are intended for you (and anyone you choose to share them with). They are not meant for public indexing. Treat the links as confidential. If a link is compromised, contact us through the methods published on the Site so we can revoke or rotate access where available.

Customer-facing report and repair pages are designed to exclude gate codes and internal technician-only notes.

10. Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain business and tax records, resolve disputes, enforce agreements, and meet legal obligations. Retention periods vary by record type (for example lead inquiries, active customer files, and security logs). When information is no longer needed, we delete or de-identify it in accordance with our operational practices, subject to backup and legal hold constraints.

11. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or alteration. No method of transmission or storage is completely secure. We cannot guarantee absolute security.

12. Your privacy rights

12.1 Arizona and general requests

Depending on applicable law, you may request access to the personal information we hold about you, ask us to correct inaccurate information, or ask us to delete information, subject to legal exceptions (for example records we must keep for service history, fraud prevention, or compliance).

12.2 California residents (CCPA/CPRA)

If you are a California resident, you may have the right to:

  • Know the categories and specific pieces of personal information we collect, the sources, purposes, and categories of third parties to whom we disclose it
  • Delete personal information, subject to exceptions
  • Correct inaccurate personal information
  • Opt out of the sale or sharing of personal information (as those terms are defined under California law)
  • Limit the use and disclosure of sensitive personal information when that right applies
  • Non-discrimination for exercising privacy rights

We do not sell personal information for money. We do not use or disclose sensitive personal information (such as precise access credentials you provide for service) for purposes that require a "Limit the Use of My Sensitive Personal Information" control beyond what is necessary to provide the services you request or as otherwise permitted by law.

You may designate an authorized agent to make a request on your behalf. We may require proof of identity and proof of the agent's authority. We will not discriminate against you for exercising rights under California law.

12.3 How to submit a request

Submit privacy requests using the contact methods published on the Site (phone, email, or Contact / support channels). Please describe the request clearly (access, deletion, correction, or opt-out). We may need to verify your identity before fulfilling a request. We do not maintain a separate data protection officer title; requests are handled by the Company through published contact channels.

13. Children's privacy

The Site and our services are directed to adults and property decision-makers. We do not knowingly collect personal information from children under 13 (or under 16 where a higher age applies for certain rights). If you believe a child provided personal information, contact us through the methods published on the Site and we will take appropriate steps to delete it.

14. Third-party links

The Site may link to third-party sites or services. Their privacy practices are governed by their own policies. We are not responsible for those practices.

15. Changes to this Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top will change when we post revisions. Material changes will be posted on this page. Continued use of the Site after an update means you acknowledge the revised Policy, except where applicable law requires a different notice or consent method.
